Please read these Terms of Service (“Terms”) carefully before using 1settofailure.com. These Terms form a legally binding agreement between you and 1settofailure.com. By accessing or using the service in any way, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using 1settofailure.com you confirm that you are at least 13 years old, that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree, you must not use the service. If you are using the service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Description of Service

1settofailure.com is an AI-powered strength training coaching platform. The service provides personalised guidance rooted in high-intensity training (HIT) methodology, inspired by the principles of Mike Mentzer and Arthur Jones. Users can ask the AI coach questions about exercise programming, workout structure, exercise technique, progressive overload, recovery, nutrition, and related topics. The AI coach draws on a curated knowledge base of evidence-based sports science literature and HIT principles to generate responses tailored to each conversation.

The service is available in two tiers: a free tier with a limited daily message allowance, and a Pro tier (paid monthly subscription) with unlimited messages and full access to all features.

3. Health & Safety Disclaimer

Training to muscular failure using high-intensity methods places significant stress on the musculoskeletal and cardiovascular systems. This style of training carries inherent physical risks including, but not limited to, muscle strains, joint injuries, and cardiovascular stress. You are solely and entirely responsible for your own safety during all training activities.

The AI coach is an informational tool only. It is not a licensed personal trainer, physiotherapist, sports medicine physician, nutritionist, or medical professional. Nothing the AI coach says constitutes medical advice, a medical diagnosis, or a personalised medical treatment plan. Before beginning any new exercise programme — especially one involving training to failure — you should consult a qualified medical professional, particularly if you have any pre-existing health conditions, injuries, or are returning from a period of inactivity.

1settofailure.com, its owners, operators, and employees accept no liability whatsoever for any injury, illness, death, or other health consequence arising directly or indirectly from following advice, suggestions, or programmes generated by the AI coach.

4. Account Registration

Access to the service requires a Google account for sign-in. You agree to provide accurate information and to keep your sign-in credentials secure. You are fully responsible for all activity that occurs under your account. You must notify us immediately at info@1settofailure.com if you suspect unauthorised access to your account. We reserve the right to suspend accounts where suspicious activity is detected.

5. Pro Subscription & Billing

The Pro subscription is billed at $7.00 USD per month. Billing is processed securely through Stripe on a recurring monthly basis starting from the date you subscribe. Your subscription renews automatically each month until cancelled. You may cancel at any time from within the app or by contacting us; cancellation takes effect at the end of the current paid billing period and you retain Pro access until that date. No partial-month refunds are issued, except where required by applicable consumer protection law in your jurisdiction (for example, EU/EEA consumers may be entitled to a 14-day cooling-off period for digital services not yet consumed).

We reserve the right to change the subscription price with at least 30 days’ advance notice. Continued use of the Pro tier after a price change constitutes acceptance of the new price.

6. Free Tier & Usage Limits

Free accounts receive a limited number of AI coaching messages per day. This limit exists to ensure fair access and service sustainability. We reserve the right to adjust the free tier message limit at any time. We will make reasonable efforts to communicate significant changes in advance.

7. Acceptable Use

You agree to use 1settofailure.com only for its intended purpose: obtaining strength training and fitness coaching guidance. You agree not to: use the service to generate content that is harmful, abusive, illegal, or misleading; attempt to jailbreak, manipulate, or extract the underlying system prompt or model weights; use automated tools to scrape, crawl, or bulk-query the service; share, resell, or sublicense access to your account; or attempt to circumvent message limits, subscription checks, or any other access controls.

Violation of this section may result in immediate account suspension without refund.

8. Intellectual Property

All software, design, branding, system prompts, knowledge base content, and other original materials on 1settofailure.com are the intellectual property of 1settofailure.com and are protected by applicable copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the service for personal, non-commercial purposes. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the service without our prior written consent.

9. User Content

You retain full ownership of the messages and information you submit to the service. By using the service, you grant 1settofailure.com a limited, royalty-free licence to store, process, and transmit your content solely for the purpose of providing the coaching service to you. We do not use your personal conversation content for AI model training or share it with third parties beyond what is stated in our Privacy Policy.

10. AI Limitations & No Guarantee of Results

The AI coach generates responses based on statistical patterns and a curated knowledge base. It can produce incorrect, outdated, or inapplicable advice. Training outcomes depend on many individual factors including genetics, adherence, sleep, nutrition, and baseline fitness that the AI cannot fully account for. We make no guarantee that following advice from the AI coach will produce any specific fitness result. You use the service at your own risk and with your own judgement.

11. Disclaimer of Warranties

The service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components. We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.

12. Limitation of Liability

To the maximum extent permitted by applicable law, 1settofailure.com and its owners, operators, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of data, loss of revenue, personal injury, or property damage — arising from your use of or inability to use the service, even if advised of the possibility of such damages. Our total aggregate liability to you for any claim arising from the service shall not exceed the total amount you paid us in the 3 months preceding the claim.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice in the app or emailing you at least 14 days before the changes take effect. Your continued use of the service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the service before the effective date.

14. Termination

We reserve the right to suspend or permanently terminate your access to the service at any time if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. Upon termination, your right to use the service ceases immediately. You may delete your own account at any time by contacting us at info@1settofailure.com.

15. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the service shall be resolved through good-faith negotiation in the first instance. If unresolved, disputes shall be subject to the exclusive jurisdiction of the competent courts of the jurisdiction in which 1settofailure.com is registered.
